A federal lawsuit accuses an Adams County deputy of busting down a bedroom door and siccing a K-9 on a man suffering from incurable colon cancer who was sitting on his toilet vomiting into a trash can.

The dog bit Michael Allyn King in the calf and caused permanent injuries, according to a lawsuit Denver attorney Anthony Viorst filed Monday in U.S. District Court.

King is suing Gilbert Abdulla, an Adams County sheriff?s deputy, and Denver police officer Jay Lopez. King is seeking compensatory damages after suffering constant pain and permanent nerve damage to his leg due to the dog bite, the lawsuit says. He is also seeking punitive damages.

The lawsuit says Abdulla was acting on inaccurate information provided by Lopez when Abdulla sought to arrest King on the afternoon of Aug. 23, 2016 in an unincorporated part of Denver in Adams County.

Lopez falsely told Abdulla that King was wanted for violating a protection order armed with a handgun, the lawsuit says. Abdulla allegedly threatened to kill his girlfriend at the time, it says. But King did not have a gun and never has been arrested for illegal possession of a firearm, the lawsuit says. The alleged incident had also happened nearly three weeks prior to the arrest, not a week earlier.

Lopez told Abdulla that King was suffering from Stage IV colon cancer, the lawsuit says. Lopez knocked on the front door for up to 10 minutes before asking Abdulla to call in a K-9 unit. But the house was occupied by several different people, and King was renting a basement room. King claims he was vomiting in a bathroom attached to his basement bedroom and did not hear the knocks.

?Abdulla made announcements into the house for Mr. King to come out with his hands up or he would send the dog in and Mr. King would get bit,? the lawsuit says.

Two males eventually opened the front door and gave their permission to enter the home, and Abdulla and another deputy went inside.

The K-9 led officers to King?s room and began barking and jumping on the door. The deputies knocked the door down and sent the K-9 inside without looking inside the bedroom or bathroom, the lawsuit says. King said he didn?t hear the dog until it jumped on top of him, bit him on the calf, latched onto him and wouldn?t let go, the lawsuit says.

When Abdulla pulled the K-9 off of King, blood immediately poured from King?s shin, the lawsuit says. King had six punctures on his right leg, including one about an inch in diameter, the lawsuit says. King required stitches, suffered permanent nerve damage and takes daily medication for chronic pain, it says.

Abdulla later reported that he deployed the K-9 because of the severity of the crime, King was resisting and eluding and that he had been caught with a gun a week earlier, the lawsuit says.

But the lawsuit says King didn?t know about the permanent protection order entered on Dec. 9, 2015 because he was an inpatient at Porter Adventist Hospital at the time and was never served with the order. He therefore wasn?t guilty of violating a restraining order and the arrest warrant was invalid, the lawsuit says.

All charges against King were later dismissed, the lawsuit says.

Charles H. Gamache was a Private First Class in the Army during World War II. Charles resided in Hampden County, Massachusetts before enlisting on April 23, 1943. At the time of enlistment, Charles was 18 years old, had 3 years of high school education and was single, without dependents. One year later, Charles was captured by Nazi Germany while serving in Italy, and was sent to Stalag 2B near Hammerstein, West Prussia where 6,291 other American POWs were held. Charles' capture was first reported to the International Committee of the Red Cross on January 23, 1944, and the last report was made on June 12, 1945.
