1857 SETTLEMENT AVERTS KEY TRIAL IN DEATHS TIED TO POLLUTION

BOSTON, Sept. 22— Eight families, who charged that water pollution by W. R. Grace & Company had resulted in the death from leukemia of five children and an adult, announced a settlement with the company today.

Lawyers for each side refused to disclose the terms of the agreement except to say it was ''substantial.'' The announcement came as the second stage in a complex trial was to begin in Federal District Court here this morning.

The trial had attracted widespread attention because of belief that a jury finding might have set a national precedent holding polluters responsible for the medical consequences of their action.

Members of the eight families from Woburn, an industrial suburb, and a spokesman for Grace differed about the implications of the settlement. ''With the settlement,'' said Anne Zona, whose brother died of leukemia in 1974 at the age of 8, ''they are admitting to what they had done and paying for it.''

''We made it unprofitable for companies to dump,'' said Kathryn Gamache, whose husband, Roland, died of leukemia while the trial was going on. ''They can no longer dump in the backyard and get away with it.'' Strain on Families Cited

But a spokesman for Grace, in a prepared statement, reiterated the company's position that it was not responsible for the chemical contamination of the two wells in Woburn or the leukemia deaths.

''We continue to maintain and are now more convinced than ever that we did not pollute the wells and we were in no way responsible for the tragic events that affected our fellow residents in the Woburn community,'' the statement said. The statement said that Grace had decided to make the settlement only because of the enormous costs of the trial and the ''additional strain on the families.''

At the end of the first stage of the trial last July, attorneys for the two sides estimated it had already cost more than $2 million. The first stage was to determine whether Grace and another concern, Beatrice Foods, had contributed to the contamination.

Beatrice was absolved of wrongdoing by the Federal jury, but Grace was charged with ''substantially'' polluting the wells with two chemicals, trichloroethylene and tetrachloroethylene, or TCE and PCE, both of them solvents.

The two wells involved were drilled by Woburn in 1964 and taken out of service in 1979 after they were found to be polluted. Near the wells, Grace's Cryovac division makes food-packaging machines where the solvents were used to clean equipment. Grace contended that there were many other sources of contamination and Woburn had been advised in 1958 not to drill the wells in that area because the underground water was already contaminated. Original Verdict Overturned

In the second stage of the trial the jury was to determine whether the chemicals caused the leukemia deaths, along with disorders of the heart and central nervous systems. If the jury had found a link between the chemicals and the diseases, a third trial would have been held to determine damages.

The complex case was further confused this morning when Federal District Judge Walter Jay Skinner ruled in favor of an appeal by Grace and ordered that the first stage be held over again because of trial errors. He said the jury had confused crucial dates about when the pollution occurred. Judge Skinner took the blame, saying questions he had posed to the jury were not ''as clear as I should have made them.''

Michael B. Keating, a lawyer for Grace, said that the judge's ruling was an important factor in reaching the settlement. Jan R. Schlichtman, an attorney for the families, said it was only a ''technical issue.'' 'I'm Glad It's Over'

The families in Woburn, 12 miles north of Boston, filed their suit in 1982, contending that the chemicals caused the leukemia deaths of five children and an adult and were responsible for leukemia in two other children.

''In one way I'm glad it's over with, but I'm sorry they didn't get nailed to the wall,'' said Mrs. Gamache.

Lauren Aufiero, whose 3-year-old son Jarred died of leukemia in 1982, said: ''These children should not have died. But maybe they died for a cause. Maybe now they will spend a little more money on hauling away their waste instead of dumping it.''

Her husband, Richard, said, ''The anger will always be there, but in our opinion there was no other way to go.''

He said part of the money the family had won would be used in an effort to reverse the verdict in the original trial on Beatrice's liability.

She was never married, and the use of the name Jefferson is not known. She brought her children to the us on the Fridleif, dep Tvedestrand, arr Quebec June 20, 1870.
Her daughter, Hedvig Jeanette Albertine born June 4, 1853, was fathered by a sailor from Stockholm, Johan Anderson. She married Aadne "Otto" Thorsen from Aukland, Rogaland, Norway. She died in 1946 in Evanston, Cook, Illinois.
Anna had 4 children by a local postman, Hans Jorgen Evensen, who was born in 1803 and 26 years her senior. He was from Drammen in Buskerud, Norway. Her children are as listed;
Herman Jorgen Immanuel Eversen was born March 23, 1857. He was called George Jefferson and married Signe Markussen.
Gustav Adolph Edemann Evensen was born May 9, 1862. He was called Edward Jefferson and was married to Minnie Schwartz and Margaret McCabe in Chicago, Illinois.
Amalie Gurine Alette Ellefine Evensen was born May 27, 1866. She was called Alvina in the U.S. and married George Lee.
Augusta Alette Ellevine Evensen was born February 10, 1859. She died young.
Anna died in 1911 and is buried in East Arkdale Cemetery in Arkdale, Adams County, Wisconsin, U.S.A.

Carl Mohar Sr., 88, of 1136 Dillingham Ave., a retired general building contractor died Saturday evening in St. Nicholas Hospital. He had been a patient for a week. He was born on Aug. 8, 1884, in Yugoslavia, son of the late Joseph and Josephine Mohar. He came to this country in 1908. On Feb. 4, 1914, he married the former Johanna Nagode in Sheboygan. Mr. Mohar was a charter member of SS. Cyril and Methodius Catholic Church, a member of KSKJ, SS. Cyril and Methodius Society, and the American Slovenian Organization. He is survived by two sons, Carl Jr., union business agent for Carpenters and Joiners Local 657, and Robert; a daughter, Mrs. Herbert (Isabella) Knocke, all of Sheboygan; 18 grandchildren and a great- grandchild. The funeral Mass will be 10 a.m. Tuesday at SS. Cyril and Methodius Church by the Rev. Louis Koren, pastor. Brief family rites will be held at 9:30 at the Gerend-Habermann Funeral Home, with burial in Greendale Cemetery. Friends may call at the funeral home after 4 p.m. today. A wake will be held there this evening.

FRANK HORZEN - Frank Horzen, Sr., 86, of 1520 Main Ave., died Sunday evening at St. Nicholas Hospital following a short illness.

A native of Yugoslavia, he was born May 8, 1880, a son of the late Antoine and Mary Horzen. Mr. Horzen lived in Sheboygan since coming to the United States in 1904.

He married the former Jennie Menart at Ss. Cyril and Methodius Catholic Church on Oct. 27, 1914.

Fr 13 years, he was an employee of the Vollrath Co. He also worked for various local furniture factories prior to his retirement in 1949.

Mr. Horzen was a charter member of the Ss. Cyril and Methodius Church and a member of the church Holy Name Society, and the S.N.P.J.

Besides his widow, he is survived by a son, Frank, Jr. of Sheboygan; three daughters, Miss Alvina Horzen of Racine, Mrs. Byron (Betty Jane) King of Oshkosh and Mrs. Myron (Mary Rose) Ferris of East Africa; 15 grandchildren and four great grandchildren.

Funeral arrangements are being handles by Nickels Funeral Home. Details will be published in Tuesday's Press.

1867 Sherry Marie (Gamache) Adams, 67, went to be with her Savior on May 18, 2014 after a valiant fight with lung disease from exposure to asbestosis. She passed away peacefully in her home and was surrounded by love, faith and family.

She was born on April 10, 1947 in Libby, Montana, the daughter of Peggy June Owen Evans and Leroy Louis Gamache. Sherry was raised by her mother Peggy and great-grandmother Emma Evans.

She was united in marriage to Duane Leon Anderson on August 5, 1963 in Bonners Ferry, ID and they made their home in Libby. They were blessed with two beautiful children, Leon Earl Anderson, born in 1964 and Amber Lynne Anderson, born in 1968. Her loving husband Duane passed away on June 17, 1987 in Seattle, Washington.

In the spring of 1989 Sherry decided to begin a new chapter in her book of life and moved to Sedro-Woolley, WA where most of her siblings resided. There she met Daniel Adams and the two were joined in heart and marriage on November 29, 1992.

Dan and Sherry spent 22 years living life to the fullest doing all their favorite things. Sherry loved making a home for Dan and herself. She had a passion for life, cooking, gardening, being Dan's biker babe on the back of his Harley, black powder shooting at rendezvous, going to the gym, camping, beading, crocheting, having a glass of wine with friends and always in her heart and on her mind was love for her family.

Sherry was the family historian. We are thankful for her interest and the ancestry trail she created. She carried the blood of the Cherokee Nation with a bit of the Hatfield persuasion. She was very proud of both.

She is survived by her husband, Daniel of the family home in Burlington, WA; son, Leon Anderson of Post Falls, ID; 2 daughters, Amber Benefield and her partner Gary Good of Libby, MT and Janel Adams Woiwod and her husband Eric of Sedro-Woolley, WA; 9 grandchildren, Duane Michel Benefield of Libby, MT, Christina Marie Benefield of Moscow, ID, Byron Fisher Benefield of Bozeman, MT, Ashley Kay Barr and Amanda Rose Anderson of Rathdrum, ID, McKayla Breanne Anderson and Katrina Logan Anderson of Post Falls, ID and Gracie Rose and Allie Woiwod of Sedro-Woolley, WA; 2 great-grandchildren, Trinity Rose Christiansen of Rathdrum, ID and Leonidus Turner Millar of Post Falls, ID; 2 brothers, Robert Mitchell and his wife Dee of Concrete, WA and Butch Allum of Sedro-Woolley, WA; 3 sisters, Wonona Kaaland and her husband Don of Sedro-Woolley, WA, Tina Mitchell-Chapel and partner Vern Montgomery of Eureka, MT and Linda Allum-Cushen of Sedro-Woolley, WA; step-dad, Theodore Allum, Sr. of Sedro-Woolley, WA; second parents, Shorty and Ethel Adams of Lyman, WA; one cousin, Darrell Katarzy and numerous nieces and nephews.

She was preceded in death by her first husband, Duane Leon Anderson; mother, Peggy June Allum; father Leroy Louis Gamache; aunt & uncle, Betty Jean & Otto Katarzy; granddaughter, Aubrey Rose Woiwod, cousin, Michael Katarzy and little brother and best friend, Wayne Douglas Mitchell.

The family wishes to express a thank you to the loving caregivers of Hospice of the Northwest, Jesse we couldn't have made it without you and especially to her sister Tina who left her family in Montana to care for her sister. Tina, we all love you.

1875 Sister Rolande Gamache, 93, of Valley City, ND, died on April 7, 2009, at Maryvale Convent in Valley City.
Sister Rolande was born on December 29, 1915, in Olga, ND, to Arthur and Hermedianne (Beauchamp) Gamache. She attended grade school in Olga. She professed her vows as a Sister of Mary of the Presentation on February 9, 1935, in Broons, France. She left the community in 1968 and reentered the community in 1997. She professed her vows again on March 6, 1999. Most of her years in Religious Community were spent as a cook for the Sisters, namely at Oakwood, Valley City, Willow City, Oakes, Bottineau, Rolla and Spring Valley, IL. She also worked as a cook at the hospital in Harvey. She retired at Maryvale in 1999.
Sister Rolande is survived by her Religious Community, the Sisters of the Presentation; three brothers: Isadore of Grand Forks, Leonard of Spokane, WA, and Edward (Pat) of Maple Lake, MN; two sisters: Helen Davidson and Marilyn Carl, both of Grand Forks; and many nieces and nephews.
She is preceded in death by her parents, brothers: Remro, Ronald, Jackie and Wayne; sisters: Dorothy, Aurice, Theresa and Irene.
The Funeral Mass for Sister Rolande is tentatively scheduled for 10:30 a.m., Friday, April 24, 2009, in Maryvale Convent Chapel.
Visitation will be from 4:00-7:00 p.m., Thursday, April 23, 2009, with a Prayer Service at 7:00 p.m. in the Chapel.
Lerud-Johnson-Schuldt Funeral Home, Valley City, is in charge of arrangements.
